By reserving a yacht or using our Service, you consent to these Terms. Should you not agree with any section of these terms, you are prohibited from utilizing the Service.
2. Service Overview
MirrorCrestPoint offers exclusive yacht charter services, which include:
- Yacht rentals by the day
- Evening voyages
- Business-related excursions
- Specialized events
- Lengthy charters over multiple days
All offerings are dependent on availability and weather conditions. We reserve the right to alter or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
For charter reservation, you are required to:
- Have a minimum age of 18 years
- Provide valid and complete details
- Remit the necessary deposit as detailed in the booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A reservation is considered confirmed following the receipt of your payment and our issuance of an official confirmation. We hold the authority to decline service at our discretion.
3.3 Availability
All yacht charters are contingent on the availability of the vessel and favorable weather conditions. We shall endeavor to accommodate your requested dates and timings.
4. Payment Terms
4.1 Pricing
Pricing for all services is indicated in € and is inclusive of all applicable taxes unless stated otherwise. Prices are subject to alteration without prior notification.
4.2 Payment Schedule
- Initial Deposit: 50% of the overall charter fee, payable at the time of reservation
- Final Payment: Due 48 hours before the charter commences
- Incidental Expenses (if applicable): Payable following the charter completion
4.3 Payment Methods
The accepted modes of payment include major credit cards, electronic bank transfers, and verified cheques. Payments are processed using secure and encrypted methods.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With a notice period exceeding 72 hours prior to departure: Full refund subject to processing fees
- Notification given 24-72 hours before departure: 50% refund granted
- For cancellations within 24 hours of departure: No refunds provided
5.2 Weather Cancellations
In instances of unsafe weather as determined by our captain, we will propose to:
- Rebook your charter for the ensuing available date without extra fees
- Issue a full refund if rescheduling is unattainable
5.3 Mechanical Issues
Should there be mechanical difficulties with the designated vessel, efforts will be made to arrange an alternate solution. If this is not possible, a complete refund will be given.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are mandated to:
- Heed instructions from the crew
- Utilize safety equipment as necessitated
- Disclose any medical conditions impacting safety
- Stay in specified areas on the vessel
6.2 Prohibited Items
The following items are not permitted onboard the yacht:
- Glass items
- Illegal substances
- Firearms or any weapons
- Overindulgence in beverages (beyond reasonable consumption)
- Pets (except those pre-approved)
6.3 Conduct
All passengers are expected to behave in a civilized and respectful manner. Should behavior jeopardize safety or disrupt others’ enjoyment, we may terminate the charter without a refund.
7. Liability and Insurance
7.1 Our Liability
Our liability is restricted to the charter fee you have paid. We are not liable for:
- Injuries sustained through personal negligence
- The loss or damage of personal belongings
- Indirect or punitive damages
- Delays resulting from weather or unforeseen circumstances not within our control
7.2 Insurance Coverage
Appropriate insurance is in place for our vessels and operations. It is recommended that customers secure their own personal and travel insurance.
7.3 Assumption of Risk
Engaging in our charter services signifies acknowledgment of inherent marine-related risks and you agree to assume responsibility for personal safety and welfare.
8. Modifications and Itinerary Changes
Changes to itineraries, routes, or timetables may occur due to weather, safety, or operational demands. We will attempt to provide a comparable alternative where feasible.
9. Force Majeure
We shall not be held accountable for alterations, deferrals, or cancellations stemming from forces beyond our authority, which include, but are not limited to:
- Dire weather conditions
- Natural disasters
- Regulatory actions
- Port blockages
- Vessel breakdowns
10. Privacy and Data Protection
We respect the privacy of your personal information, which is processed in accordance with our Privacy Policy. Utilizing our services implies consent to the collection and use of your data as outlined in the Privacy Policy.
11. Intellectual Property
All content on our site, including but not limited to text, images, logos, and graphics, is legally protected. Unauthorized reproduction, distribution, or creation of derivative works is prohibited without our explicit consent.
12. Governing Law
The governing laws of Germany apply to these Terms, with any disputes to be resolved within the jurisdiction of courts in Hamburg, Germany.
13. Changes to Terms
